#RegulatoryUpdate Ministry Of Information & Broadcasting convened a meeting with industry associations yesterday on 11 June to discuss compliance with the new guidelines issued by it on 5 June. The industry's request for a time extension is unlikely to be entertained. So the deadline remains 18 June. It has also been reiterated that MIB does not have the locus standi to intervene on the subject, as it merely executes Hon'ble SC's orders. The aggrieved will need to implead before the SC after courts reopen in July. 📀New self-declaration mechanism for Advertising and its compliance obligation from 18 June 2024📀 ⏯ Starting 18th June, advertisers must submit self-declaration forms before running ads on print, TV, and the internet. Specifically, they need to confirm that the ad does not make misleading claims and complies with all relevant regulatory guidelines by submitting a self-declaration form on MIB portals. (The form will include details of ads such as title, description, and full script) ⏯ Context & Sequence of Events ♦ Indian Medical Association filed a case against Patanjali prccs for misleading claims following which the Hon'ble Supreme Court of India issued warnings to Patanjali, and eventually placed temporary bans on its ads. Patanjali was also directed to publish apologies in newspapers etc. ♦ On 7 May 2024, SC extended the scope of the case to all ads, making it sector agnostic, and announced a mandatory self-declaration regime for running ads, urging Ministries to establish procedures that will encourage consumers to lodge complaints. ♦ Specifically, it directs MIB to create a dedicated portal within 4 weeks ♦ On 5 June 2024, MIB operationalizes portals and issues guidelines for compliance ⏯ Nature of Compliance – The Advertiser must upload a self-declaration form on www.broadcastseva.gov.in and www.presscouncil.nic.in before any ad is issued on the TV/print/internet. Proof of uploading is to be shared by the Advertiser with the concerned broadcaster/printer/publisher/TV channel/ electronic media. No Ad is permitted to be run without uploading the self-declaration. These are to be treated as laws declared by the SC under Section 141 of the Constitution of India ⏯ Grey Areas – ♦ The complex and nuanced nature of digital ads esp. via automated tools is yet to be defined. ♦ Clarity on scope – mediums impacted, the format of declaration, the mechanism to operationalize the order ♦ If the self-declarations are made public on the two portals, it will create privacy risks and become anti-competitive ⏯ Compliance burden on small businesses (as always) – Smaller players hugely rely on digital ads for visibility and promoting their business ⏯ Key Recommendations ♦ Extension of go-live date of 18 June ♦ Different approaches for digital ads ♦ Exemption for small businesses ♦ Consider an initial trial period for roll-out ⏯ Next Steps- MIB will convene a meeting on 11 June with key stakeholders to ensure implementation and peruse

A new debate on the cost of cool, which digs into the environmental impact of increasing vinyl sales and rising concerns among several major artists. In summary, some counter-argue that the tech behind vinyls is significantly evolving, notably with BioVinyl, whilst others mention the environmental cost of storage data from streaming platforms. For me, it is entertainment, it is what consumers want, and it is the same debate as EV cars vs. good old gas. It’s evolution meets nostalgia. What do you reckon?

Iger says it’s their “biggest foray ever” into gaming and now Disney is going to allow developers "the opportunity to create their own wholly unique Disney-themed gaming experiences" (see pocketgamer article in comments) Why is this significant? Well, the House of Mouse is the undoubted master of IP building and crucially of CONTROLLING how they’re managed. And whilst in these days of UGC platforms it’s not unusual for IP to be ‘borrowed’ by creators, this marks an acknowledgment by Disney that by ceding *some* control (amount tbc) it puts their characters and worlds into the hands of many more users and creators than ever before. It sounds risky handing over your IP right? Especially when you can’t fully dictate how it will be used? (Again, the extent to which Disney will hand over the reigns with their IP is to be revealed) but this marks an acknowledgement of the user-centric era that you may have heard me and others talk about. Joe Condon explains it eloquently in his excellent newsletter - also linked in comments. Disney opening up use of their IP is powerful because it unlocks: 💰‘Hands Off’ Marketing & Revenue Generation - in a simplified way, the beauty of UGC is that once all the assets have been created and the IP integrated into the platform, the power can be with the creators to do a lot of the heavy lifting in marketing the IP and building the experiences that can eventually drive revenue for your brand. It’s a win-win. Low-lift, large reach, and quick feedback on what’s resonating, and what’s not. 💭Insight into Crossovers & The Big Screen Implications - Disney has such diverse IP that it attracts audiences from Gen A to Baby Boomers. With Fortnite about to play home to a concoction of these IP, it’ll provide invaluable (and real-time) feedback on which of their IPs are resonating the most with Fortnite’s audience, and what crossovers are most popular. You’d imagine this insight will be helping to advise decisions at Disney around which of their IPs are worth funding for future films and crossovers on the big screen so they get the most bang for their buck.

Right sizing is a big deal. I don’t think it’s ever a bad idea, but a way to make smarter content decisions. Invest in the people that are making the content that sparks interest vs. just passive viewing.

As our smart TV home screens gravitate to global viewing, it stands to reason that expanding the Geo-Block ban on the audio-visual sector must include expiration of regional licences and introduce one single content licence. Not just for Europe, but for every streaming territory as a whole. Although much can be said about content quotas, they are in fact near-sighted to the fact that technology and consumers are driving this demand because of the content choices audiences are making. Netflix features content in over 60 languages, with 80% of the platform’s users claiming to use subtitles at least once a week. This implies that content providers would be compelled to make movies and TV shows unlicensed in one country but sold in a neighbour available on the same streaming service on the same device in Amsterdam or Sydney. The new Goldman Sachs report is extremely positive and bullish on music revenue growth (& streaming price increases) with their latest 'Music In The Air' report just released. Goldman Sachs has raised its "2024-30 CAGR" (the compound annual growth rate from now until the end of 2030) for the global music market, from +7.4% to +7.6%, and included predicting +10% and +11% YoY growth for the recorded and publishing markets. Its prediction for the gross revenues of the global music market at the end of 2030 is $163.7bn (compared to $98.3bn for 2023). The report contains other analytic predictions that explain its confidence in future music industry growth. Those predictions are: further upcoming price increases for music streaming subscriptions (the company models an approximate 3% average annual price increase); the suspected launch of "super premium plans catering to superfans"; the anticipated adoption of artist-centric payment models by more streaming platforms; and the "development of a framework and monetisation avenue for the use of music content by Generative AI models."
