#AssetRecovery Team members Warren Gluck and Alex Englander recently secured a win during a Chapter 11 bankruptcy proceeding for Paradise Adventures LLC, a boat charter company. Acting as counsel to the primary #creditor, our attorneys defeated a cash collateral motion and motion to displace the receiver in this bankruptcy. The order denying these motions noted "that Debtor has mismanaged its business, assets, and financial affairs pre-petition is patently true," and with this result, we assured our client's #assets remain safe while the #bankruptcy #litigation plays out. This ruling serves as a reminder of the #fiduciary duties owed by debtors-in-possession and the potential consequences of failing to meet those obligations.
