Rubberband Ball help

My buddy just unlocked the rubber band ball but when he chooses it from his inventory it doesn't show up in Jimmys hand and it wont even let him use the rubber band ball, has anyone had this problem and will the patch they released for the glitches fix it?

Did he already use it? Because you can only use it once.

You unlock the rubber band ball by collecting all one hundred rubber bands.
