By accepting this agreement or by installing "SpaceEngine" (the Software) or by clicking "Install", you agree to the following terms, notwithstanding anything to the contrary in this agreement. LICENSE
Copyright of the "SpaceEngine" software (the "Software") belongs to Cosmographic Software LLC (the "Licensor"). The Licensor reserves all other rights in the Software not expressly granted to you here. Subject to your compliance with these terms and conditions, the Licensor grants you a royalty-free, non-exclusive license to use or run the Software for personal, non-commercial use only, and to copy and distribute any content created with the Software (screenshots, video, textures, scripts, but not soundtrack), for personal, non-commercial educational presentations, charity and other non-commercial use. Copyright and other intellectual property laws and treaties protect this Software Product. The Software Product is licensed, not sold. If you wish to use the Software or content created with the Software for commercial purposes, please purchase the SpaceEngine PRO DLC available on Steam.
RIGHTS FOR "RE-USE"
You receive the right to re-use images, videos, and other such media created in the Software for the purposes of non-commercial education and non-commercial virtual exhibits, provided that "SpaceEngine" is credited either by a caption on the image which might reasonably considered to be visible when included, or in such a manner as is typical for the purpose, such as inclusion in a credits or acknowledgements section, as “SpaceEngine © Cosmographic Software LLC.”
You receive the right to create and make publicly available videos containing images, video and sounds of the Software through social media channels such as Twitch.tv and Youtube.com, through so-called “Let´s Play" videos or "livestream" presentations, under the provision that they are not monetized in any way. Donations such as "Superchat" are not considered monetization for this purpose. Soundtracks may only be made publicly available in the context of a "Let´s Play" video or "livestream" in which showcasing the Software and its gameplay is the primary content. In the context of any such "Let´s Play" video or "livestream", the following copyright notice must be displayed prominently in the video description: “SpaceEngine © Cosmographic Software LLC.”
LIMITATIONS
The source code, design, and structure of the Software are trade secrets. You will not disassemble, decompile, reverse engineer, or distribute it, in whole or in part, except to the extent expressly permitted by law. You will not sell the Software or any parts thereof, or charge others for use of it (either for profit or merely to recover your media and distribution costs) whether as a stand-alone product, as part of a compilation or anthology, or included in a separate software package, without being granted explicit prior written permission by the Licensor. You will not remove or alter any copyright or license notices contained in the Software and documentation, or remove or alter any identifying elements, including splash screens and logos, or try to hide or reassign in any way the name or origin of the software or any of its components. You will not use the Software or any parts thereof to advertise, promote, present or sell any software or other product or service without explicit prior written permission granted by the Licensor. You will not use the Software to engage in or allow others to engage in any illegal activity.
DISCLAIMER OF WARRANTIES
The Software is provided by the Licensor "as is". The Licensor disclaims any responsibility for harm resulting from the Software or any software or content downloaded using the Software, whether or not the Licensor approved such software or content. The Licensor expressly disclaims all warranties and conditions, expressed or implied, including any implied warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement, and any warranties and conditions arising out of course of dealing or usage of trade regarding the Software or any software or content you download using the Software. INDEMNIFICATION
You agree to, and hereby defend, indemnify, and hold the Licensor, Cosmographic Software LLC, and any officers or affiliates thereof, harmless from and against any and all claims, damages, losses, costs, investigations, liabilities, fines, penalties, judgements, settlements, expenses (including attorneys' fees), and judgements that directly or indirectly arise out of or in connection with your use of the Software, whether occurring heretofore or hereafter, including any violation of any laws, rules, regulations, statutes, codes ordinances or orders of any government, governmental, or quasi-governmental organization or authority in connection with your use of the Software. The Licensor, its officers and associates, retain the exclusive right to settle, compromise, and pay any Claims and Losses. AMENDMENT AND MODIFICATION
The Licensor may amend, modify, or update the terms of this License at any time by providing the User with written notice. Continued use of the Software is considered to be acceptance of any such amendment by the Licensee. For the avoidance of doubt, written notice can be in the form of a new or modified License updated on Steam or on Licensor's website.
Licensor reserves the exclusive right to make modifications to certain parts of this License on an individual and case-by-case, such as exempting individual entities from individual clauses or sub-clauses on a case-by-case basis. Such modifications will be granted explicitly in writing by Licensor, and do not constitute in any way an additional waiver or grant any additional rights, or otherwise serve as an invalidation or waiver of any other part of this License except as expressly dictated in writing by Licensor to the Licensee in such case.
SEVERABILITY
In the event that any party of the provisions of this License are held to be invalid or unenforceable in whole or in part, all other provisions will nevertheless continue to be valid and enforceable with the invalid or unenforceable parts severed from the remainder of this License.
